The following excerpt is from Engel v. Rabie, B288518 (Cal. App. 2018):
"A person who is not a party to a contract may nevertheless enforce it if the contract was made expressly for his benefit. (Civ. Code, 1559.) For a third party to qualify as a beneficiary of a contract, the contracting parties must have intended to benefit that third party and their intent must be evident in the terms of the contract. [Citation.]"4 (Amaral v. Cintas Corp. No. 2 (2008) 163 Cal.App.4th 1157, 1193.)
