The plaintiffs argue the delay in this action is not inordinate or inexcusable. The delay prior to obtaining legal counsel is excusable because the plaintiffs were not familiar with the legal system: Bay v. Family Insurance Corporation, 2008 BCSC 1164. Further, the plaintiffs say the defendants contributed to the delay by postponing examinations for discovery and by failing to respond to requests for documents arising out of the discoveries and to suggested trial dates.
