MACKENZIE, J.A.—I cannot distinguish this case from Monticello State Bank v. Killoran, 1921 CanLII 21 (SCC), 61 S.C.R. 528, [1921] 1 W.W.R. 988, and would hold that the document sued on herein is a promissory note. I think the appeal should be dismissed with costs. Appeal dismissed with costs.
