15. In Ansari v. The Owners, Strata Plan LMS 75, 2020 BCCRT 651 (which is not binding on me but provides guidance), a CRT member considered a similar bylaw to the one at issue. The bylaw stated that an owner was responsible for damage caused by occupants, tenants or visitors to their strata lot. The CRT member concluded that the applicant in that dispute was responsible for fire damage caused by a guest, from the “act” of discarding a cigarette.
